Terms of Sale
Sell Your Classics.com's intent is to put together buyers, sellers and hobbyists of Vehicles, Automobilia, Merchandise and Misc. Information about a particular vehicles or items. The ad information is supplied by the seller and not by Sellyourclassics.com. The price and other terms of any sale remain subject to direct negotiation between the buyer and the seller. All sellers must have the ability to transfer title or ownership before posting ads on Sellyourclassics.com. This means we do not allow brokers or third party advertisers to post ads online, without written consent from the owners of the vehicle or merchandise and the ability to transfer title or ownership of the item being listed. Sellyourclassics.com reserves the right to refuse service and remove ads at any time from any sellers, dealers or brokers that we feel are not meeting the terms and conditions in this user terms and agreement. The prices listed by sellers on Sellyourclassics.com often exclude sales tax, finance charges, title, license, regulatory, dealer documentary, emission testing, compliance fees, and other related charges, any or all of which may be added to the listed price to arrive at the final sale price of a particular vehicle or item. Though we hope that all who come to Sellyourclassics.com will act honorably and treat each other fairly, we cannot verify the information sellers supply or guarantee the vehicle or item they offer. Nor can we assure the seller of a vehicle or item that the payment he/she gets from the buyer is valid. When you offer a vehicle or item for sale through Sellyourclassics.com, you must be prepared to sell that vehicle or item at the price at which, and the terms on which, you've listed it. To list a vehicle or item for sale on Sellyourclassics.com, sellers are required to provide certain identifying and contact information. The information must accurately identify the seller and the method of contact must permit buyers to communicate directly with the seller. You may not charge any potential buyer for information about any vehicle or item listed for sale on Sellyourclassics.com, nor may you use our website to promote, without our prior written permission, any other website, product or service. Sellyourclassics.com reserves the right to deny use of this website to anyone who does not comply with these requirements or who otherwise uses our website in a manner we consider inappropriate.Sellyourclassics.com cannot monitor all the listings posted to our website, we reserve the right (but assume no obligation) to delete, move, or edit any listings or other postings that come to our attention that we consider unacceptable or inappropriate, whether for legal or other reasons. By using Sellyourclassics.com you agree not to post or transmit any defamatory, abusive, obscene, threatening, misleading, or illegal material, or any other material that infringes on the rights of others or interferes with the ability of others to enjoy Sellyourclassics.com. We retain the right to deny access to anyone who we believe has violated these terms or any other term of this agreement. By submitting a listing through our service, you agree to pay the fees if specified for the listing package you select, regardless of whether your vehicle or item sells as a result of the listing.
Our Relationship
Under the scope of service outlined in "Service Agreement", Sell Your Classics (hereafter SYC) is acting as an agent for the Seller of the Vehicle. We are not in possession of the Vehicle(s) offered or advertised. SYC is providing a service to the Seller. Sellers have the right to sell the vehicle outright at any time. The Vehicle is being offered for sale through many venues which may include eBay Motors. SYC reserves the right to end any eBay auction at any time for any reason.
AS IS Sale
All vehicles are sold "AS IS WHERE IS" and with no warranties or guaranties of any type either expressed or implied made by SYC. Any warranties made by the Seller must be in writing on an instrument separate from the Bill of Sale and signed by both the Buyer and the Seller. In no event shall SYA, the auctioneer, any employee, or 3rd party agent or associate of SYC be responsible or liable for such warranties, guarantees or description of any Vehicle offered for sale.
Accuracy of Description
The Vehicle(s) being offered are in general older or used and are not perfect and not every flaw of the item can be listed. All Vehicle description/statements printed in SYC ads, showroom listings and auction descriptions as well as verbal statements made by the auctioneer or agents, have come directly from the Seller and are accepted as reliable. SYC has done its best to ensure the accuracy and completeness of the description of the Vehicle's attributes and overall condition. SYC will attempt to obtain all answers to any questions you may have. SYC assumes no responsibility or liability for representations made by Sellers and shall have no obligation to verify or authenticate such statements or claims.
Deposit Refunds & Inspection
All Vehicles are offered with the right to a pre-purchase inspection before the transaction is finalized. SYC can arrange to have the vehicle sent to an authorized or qualified dealer or have a qualified 3rd party agent inspect the Vehicle on site. Buyer may also personally inspect the Vehicle; send their own inspector or all of the above. Buyer is responsible for the entire cost of the inspection. SYC must receive a deposit of 5% of the final bid/agreed sale price and must be paid within 72 hours to secure sale of the vehicle prior to inspection. This deposit will be refunded in the event the Seller has materially misrepresented the vehicle. Inspections must be done within 10 calendar days, after the close of the auction or receipt of deposit monies, whichever comes first. Otherwise, it is assumed the Vehicle is to be accepted without an inspection. Once the vehicle is approved by the buyer (or 10 days have passed), the deposit becomes non-refundable and the remaining balance must be paid directly to the seller, or held in escrow by SYC.
Reserve Price
Unless the sale of a vehicle is advertised or announced to be otherwise, each Vehicle is offered subject to the reserve price of the Seller. WE DO NOT GIVE OUT RESERVE, so please do not ask.
Payment
Deposits and Final Payments must be in certified funds, defined as cash, a certified check, money order, traveler's checks, or wire transfer within a reasonable time frame as stated in auction description or as mutually agreed to by SYC and Seller. Title for any vehicle purchased may be withheld until Buyer's funds clear the Seller's or SYC's bank account. Delivery and Storage
All Vehicles shall be removed from the Sellers premises by the Buyer at Buyer's expense following the sale within a time frame mutually agreed to by Buyer and Seller. If not so removed, Seller may store or remove the Vehicle with all costs of moving and storage to be paid by the Buyer. Arranging transport of Vehicle is Buyer's sole responsibility. SYC will assist in arranging such transport service for an additional fee.
